Even if you believe your divorce will be uncontested, you should meet with an attorney. Once you decide that divorce is necessary, retaining a knowledgeable family law attorney as soon as possible is one of the best ways to preserve your long-term financial and emotional health.

Child Custody

Child custody issues affect everyone concerned—not only the parents and their children, but family members as well, including grandparents, cousins, even close friends. The New York City attorneys of Ketover & Associates are experienced in all types of custody matters. Types of custody include:

  • Joint custody - parents share physical and legal custody.
  • Sole physical custody - the child lives with and is under the supervision of one parent; the other parent often has visitation rights.
  • Joint physical custody - each parent has significant periods of physical custody.
  • Sole legal custody - one parent has the right and the responsibility to make the decisions relating to the health, education and welfare of a child.
  • Joint legal custody - both parents share the rights and responsibilities to make decisions concerning the health, education and welfare of the child.

Child custody matters are unpredictable but seeking the advice of proper legal counsel will help towards resolving volatile issues, and help draw all matters to a satisfactory resolution.

Grandparents' Rights

When the Visitation Rights Enforcement Act was signed into law on November 12, 1998, it made provisions for grandparent visitation, not only within one state, but from state to state. It guaranteed that after divorce, grandparents can visit grandchildren living with a custodial parent anywhere in the United States, as long as they have visitation rights in one state.

The nature and the extent of the grandparent-grandchild relationship, as well as the nature of a parent's objection to visitation (if any) is essential to the investigation. The Court determines whether it's in the best interest of the child to allow grandparent visitation. To ensure visitation rights, grandparents are advised to retain a qualified attorney to advocate on their behalf.
